Lowndes Jordan has a significant construction practice with expertise in drafting and reviewing a wide range of construction and commercial contracts (including shareholder and financing contracts) and in assisting to resolve construction disputes. We enjoy supporting New Zealand’s construction industry and are members of the Society of Construction Law. Our expertise in property, insolvency and intellectual property, as well as our strong litigation practice, greatly assists our construction team.

Examples of our recent work include:

  • advising developers on significant marina developments throughout New Zealand, with overall construction contract costs ranging from $10 - $30 million+;
  • advising a design consultancy services provider on a range of matters, including contracts for consulting services on IPENZ Short Form and CCCS, leasing, construction contracts on NZS3910 and NZ3915, master services agreements, subcontractor agreements and purchase terms;
  • acting for the principal in respect of the construction of a major University campus building;
  • advising consulting engineers on their contractual arrangements for a project in the Christchurch rebuild;
  • acting for other suppliers to the construction industry, such as quantity surveyors, giving us a good understanding of the issues impacting the industry generally;
  • acting for and advising contractors in disputes with subcontractors and principals including successfully seeking injunctive relief in relation to performance bonds;
  • acting for a contractor with respect to insolvency of a subcontractor;
  • acting in large scale civil proceedings in relation to high value infrastructure contracts; and
  • acting for body corporates and owners in relation to leaky buildings and failed remediation.
